20th amending regulation to the legal regulation on transport fees and conditions with taxis registered in the Rheinisch-Bergischer Kreis (taxis tariff) of December 19, 1975. The amending regulation comes into force on December 1, 2022, but no earlier than the day of publication.
1. When transporting passengers with taxis registered in the Rheinisch-Bergischer Kreis, the following tariff applies in the compulsory travel area.
2. The compulsory driving area includes the area of the Rheinisch-Bergischer Kreis.
3. For journeys outside the compulsory driving area, Section 37 paragraph 3 of the Regulation on the operation of motor vehicle undertakings applies.
in passenger transport (BOKraft) of 21 June 1975 (BGBl. I p. 1573), last amended by Article 483 of the Ordinance of 31 August 2015 (BGBl. I p. 1474).
1. Waiting times include all downtimes during the use of the service, unless the downtime is the fault of the driver or occurs due to technical defects in the vehicle. This exclusion also applies to all accidents in which the vehicle is directly involved.
2. The driver of a taxi is not obliged to wait longer than 30 minutes.
3. a) Waiting times are charged at 10 cents per 8.93 seconds (40.30 euros/hour) for the first 10 minutes.
b) Waiting times are charged from the 11th minute at 10 cents per 7.19 seconds (50.10 euros/hour). The tariff change from the waiting time for the first
10 minutes of waiting time from the 11th minute onwards must be automatically calculated by the fare display.
Medical journeys are not subject to this tariff if contracts with public funding bodies exist for their execution.

2. The driver of a taxi is not obliged to wait longer than 30 minutes.
3. a) Waiting times are charged at 10 cents per 10.91 seconds (33 euros/hour) for the first 10 minutes.
b) Waiting times will be charged from the 11th minute onwards at a rate of 10 cents per 8.78 seconds (41 euros/hour).
The tariff change from the waiting time for the first 10 minutes to the waiting time from the 11th minute onwards must be carried out automatically by the fare display.
The surcharge for journeys in large-capacity taxis (passenger cars which, due to their design and equipment, are approved and suitable for the transport of more than 5 people including the driver) is 7.70 euros. The surcharge is due when the large-capacity taxi is specifically requested or when one is used at the taxi stand by more than 4 passengers. The surcharge
must be displayed on the fare display.
1. A surcharge of 70 cents may be charged for the carriage of luggage and a surcharge of 35 cents for the carriage of small animals. The surcharge must appear on the fare display.
2. Guide dogs may be transported free of charge.
The fare must be carried in every taxi and shown to the passenger upon request.
If a journey cannot be carried out after the order has been placed for reasons for which the customer is responsible, three times the basic price must be paid for a journey cancelled within the municipality of the company's headquarters and six times the basic price beyond the borders of the municipality of the company's headquarters.
1. The transport charges must be displayed on the fare display (Section 28 BOKraft).
2. Transport within the compulsory travel area may only be undertaken with a properly functioning fare display.
3. If a fault occurs with the fare display during a journey within the mandatory travel area, the vehicle may no longer be used to transport passengers after the journey has ended, but only after the fare display has been restored to working order. Both the operator and the taxi driver are responsible for restoring the functionality of the fare display.
4. If the fare display is faulty, a fee of EUR 2.80 must be paid for each occupied kilometre.
5. If a fault occurs during the journey, the journey must not be carried out. This fault is at the expense of the operator. In such a case, the taxi driver is obliged to notify another taxi equipped with a properly functioning fare display by radio.
6. The passenger must be informed immediately of any disruption that occurs during the journey. He must be informed that the fare will be calculated in accordance with paragraph 4 from the time of the disruption.
1. The following conditions apply to carriage:
1.1 The taxi driver assists passengers with getting in and out of the taxi and with loading and unloading luggage; he opens and closes the taxi door.
1.2 The taxi driver may assign seats to passengers; the wishes of the passengers must be taken into account as far as possible.
1.3 Luggage, with the exception of small hand luggage, must be stored in the trunk of the vehicle. As long as operational safety permits, the taxi driver may allow the luggage to be stored elsewhere.
1.4 Dogs and small animals may be taken along as long as the operation of the taxi and traffic are not endangered. Guide dogs are always transported when accompanied by blind people. The passenger is responsible for supervising animals taken along; he is liable for any damage caused by taking the animals along.
1.5 The passenger is obliged to inform the taxi driver of his destination at the start of the journey and to inform him in good time of any changes or requests regarding the route.
1.6 The fare is generally payable to the taxi driver at the end of the journey. However, in special cases the taxi driver may request an advance payment of an amount corresponding to the estimated fare before the journey begins. The taxi driver must carry sufficient change.
1.7 Any costs incurred by passengers or animals travelling with them due to damage or soiling of the taxi must be reimbursed by the passenger.
1.8 If the performance of the transport is prevented by circumstances which the taxi driver could not prevent or remedy, no claims for compensation shall arise.
2. The conditions of carriage become part of the transport contract when the fare is used.
3. The relevant statutory provisions, in particular those of the Ordinance on the Operation of Motor Vehicle Undertakings in Passenger Transport (BOKraft) of 21 June 1975 (Federal Law Gazette I p. 1573), last amended by Article 483 of the Ordinance of 31 August 2015 (Federal Law Gazette I p. 1474), are not affected by these Conditions of Carriage.
Violations of this taxi tariff will be punished according to Section 61 of the Passenger Transport Act (PBefG) in conjunction with
§ 45 BOKraft is punishable as an administrative offence with a fine of up to 5,000 euros, provided that it was committed intentionally or negligently and is not punishable under other provisions.
